Membership Terms
General
I understand and agree regarding FFP Membership that:
- Membership Fees are non-refundable, auto-renewing, and not tax-deductible.
- I must contact FFP no later than 14 days after an auto-renewal charge to my card to request a refund. All of my auto-renewal membership charges are non-refundable after the 14-day auto-renewal refund period.
- If I choose to dispute the charge with my bank rather than cancel through FFP, FFP will issue a $25 dispute/handling fee.
- In the event of a division of property between spouses, membership will remain in the name of the primary member.
- Membership should be in the name of a parent or legal guardian (the person standing in parental authority).
- The only children covered under the membership are biological or adoptive children of the member or any children for whom the member has been granted legal custody by a court.
- Legal representation provided by FFP does not apply to pre-existing CPS matters, or where the facts under dispute arose prior to FFP membership.
- I have not been convicted of or prosecuted for any crimes against a child.
- I do not currently engage in, and have not within the last 5 years engaged in the consumption, sale, or distribution of any controlled substance (drugs) that would be in violation of State or Federal law.
I understand and accept the following; FFP Serves all Texas families regardless of race, creed, or religion. FFP reserves the right to reject any membership application and will refund membership fee upon denial of membership. FFP reserves the right to revoke any membership if application information has been misrepresented. In such cases, no refund of membership fee will be made.
Legal Representation
1. Definitions
Legal Assistance: A decision by FFP to retain an attorney on behalf of a member in response to, and for the purpose of resolving, an active CPS investigation against the member family.
Matter: The event, occurrence, or subject matter of controversy.
2. Scope of Legal Representation; Not an Insurance Company.
FFP does not provide insurance coverage. We do not guarantee representation in every case. The extent of legal coverage for FFP members is subject to the limitations below.
Legal protection through FFP includes representation during, in response to, and for the purpose of resolving an active CPS investigation and does not include legal representation in any legal action filed by CPS in a court of law or any other action taken by CPS related to the FFP member family.
3. General Exclusions and Limitations
As part of our services to FFP member families and to advance the rights of families generally, FFP often provides legal representation to FFP member families.
However, FFP membership is not legal insurance. All legal representation is done at the direction of FFP’s board of directors with a focus on advancing the organization’s mission, not simply the private interests of FFP member families. The following guidelines are relevant to the selection of matters for which FFP will consider providing assistance, however such decisions are at FFP’s sole discretion.
Legal representation provided by FFP does not apply to pre-existing CPS matters in which the facts under dispute arose prior to FFP membership.
At FFP’s sole discretion, FFP may choose to offer legal representation to a member above and beyond what is required by the terms of FFP membership. Such additional legal representation is fully within FFP’s discretion to provide or not to provide based on whether it furthers the mission of FFP. The offering of additional representation beyond what is required by these membership terms shall not be construed as the acceptance of an obligation by FFP to continue providing such representation. The scope of such representation and the continuation of such representation shall be at the sole discretion of FFP.
By signing this agreement, you agree to be honest and truthful in all communications with FFP, to disclose and provide all relevant facts and documents in a timely manner to FFP–or to FFP-provided legal counsel–that are related to your request for legal representation, and to fully and timely cooperate with any request by FFP which FFP has deemed necessary for effective legal representation on your behalf.
Legal representation and associated services are presumed to be conducted in English and do not include translation services. An attorney retained by FFP on the member’s behalf may speak additional languages, but FFP is not required to provide such an attorney.
Legal representation is provided only for covered disputes arising under the laws and within the geographic boundaries of the State of Texas.
We reserve the right to conduct a preliminary investigation prior to initiating legal representation. We reserve the right to decline or terminate legal representation for any reason including but not limited to, if in our sole and absolute discretion, we believe that actual abuse, neglect, or other misconduct has occurred or is occurring; that a conflict of interest exists; that the member has engaged in conduct that is morally reprehensible and damaging to the child or that violates a sincerely held religious belief of FFP, such that we cannot in good conscience provide legal representation on behalf of the member family.
Legal representation is not provided in response to matters arising directly or indirectly from a report made by a biological, step, or legal parent or guardian of the child.
